Total days of basic wage

An estimate for planning, not legal advice. It assumes a private-sector employee on a UAE mainland contract, on basic salary only. Free-zone schemes such as DIFC and ADGM may differ.

How it is calculated

  1. Count the days of service, minus any unpaid leave. Under 1 year, nothing is due.
  2. Add 21 days of basic wage for each of the first 5 years.
  3. Add 30 days for each year after the fifth. Part years count pro rata.
  4. Multiply the days by the daily basic wage (monthly basic ÷ 30). The total is capped at 24 months of basic wage.

Questions

How is UAE gratuity calculated?

For each of the first 5 years, the employee earns 21 days of basic salary. For each year after that, 30 days. Part years count pro rata, and the total cannot exceed 2 years of wage.

Is gratuity based on basic salary or total salary?

Basic salary only. Housing, transport and other allowances are not included.

Who gets gratuity in the UAE?

Employees who complete at least 1 year of continuous service. There is no gratuity for dismissal for gross misconduct under Article 44 of the labour law.

Does this work for free-zone employees?

Not always. DIFC and ADGM employers use their own end-of-service schemes, such as DEWS. Check your contract or ask your HR team.
